Medical Examiner testifies at Goldberg trial

EUREKA- A pathologist told a Humboldt County jury Wednesday that Fortuna firefighter Tim Smith was shot five times. Four of those five, said the doctor in the murder trial of Jon Goldberg, were potentially fatal.

The 37-year old Goldberg of Bridgeville is on trial for the murder of Tim Smith in 2016. Authorities allege that Goldberg shot Smith because he was having an affair with Goldberg’s wife.

Jurors saw graphic photos of Smith’s autopsy. Smith’s family, attending the trial, waited outside the courtroom. Photos showed the bullet wounds to the torso.   They are part of the state’s case that Jon Goldberg premeditated the shooting of his former friend. Smith was found shot in his driveway.

Goldberg’s defense attorney said his client did not plan the shooting but allegedly acted out of impulse.

The trial continues Thursday.
