Charmaine Andrews-Stapp was a passenger on the rear of the motorcycle driven by Stapp. Eller failed to slow the motorcycle and attempted to pass the Subaru on the left as the Subaru turned into the driveway. The motorcycle collided with the left side of the Subaru. Eller and Stapp sustained major injuries as a result of this collision and were transported to St. Joseph's Hospital in Eureka. Eller was ultimately transferred to Santa Rosa Memorial for treatment of his injuries. Stapp was wearing a helmet however, Eller was not. The motorcycle Eller was operating at the time of the collision was determined to be a stolen vehicle. Eller was determined to be under the influence and placed under arrest for felony DUI (causing injury) and vehicle theft and released to the hospital for treatment of his injuries.
