Thomas McClain's family to file wrongful death claim against City of Eureka, EPD
EUREKA- The family of Thomas McClain, the man who was shot and killed by a Eureka Police Officer last September, announced Friday they will be filing a wrongful death claim against the City of Eureka, as well as two police officers.
Thomas McClain was shot by officer Stephen Linfoot on September 17th, after McClain was reportedly seen reaching for a bb gun in his waistband. The D.A. has decided not to press charges and a shooting review board cleared Linfoot last month.
The family plans to file a claim for $10 million in damages on Monday. In 45 days, they intend to file a lawsuit in federal court alleging wrongful death and civil rights violations.
