Assault with Deadly Weapon: Suspect in Custody

EUREKA, Ca. (KIEM) – A man suspected of assault with a deadly weapon is now in police custody.

Eureka police responded to the 1500 block of 3rd Street for a report of vandalism to a vehicle on Sunday afternoon.

While on the phone with the reporting party, the dispatcher heard what sounded like the victim in an argument with someone.  According to officials, someone was heard shouting “there’s a gun”.

Officers located the victim and 52-year-old Sean Thomas Avery in a physical fight in the suspect’s apartment.

According to police, the victim says he attempted to exit his apartment while on the phone with dispatch. When he was confronted by Avery who was allegedly holding a handgun.

A fight broke out after Avery grabbed the victim and pushed him back into the apartment.

During the altercation, the gun went off and fired a round into the floor next to the victim’s head. When he tried to escape, police say Avery put him into a choke hold.

During a search, detectives found a ballistic vest, a disassembled revolver, ammunition, and the gun case and manual for the one used in the assault.

Avery is facing a number of charges including assault with a deadly weapon, kidnapping, assault, and battery. His bail is set at $75,000.
