Goldberg trial now in jury’s hands

EUREKA- A defense attorney for Jon Goldberg said he did not intend to kill his friend, Tim Smith, when he shot him five times.

Jurors in Goldberg’s murder trial heard defense attorney Casey Russo claim that his client was caught in a perfect storm of emotions when he learned of an affair between his wife and the Fortuna firefighter.

The attorney said that Goldberg shot out of fear that Tim Smith had a gun in his truck nearby. He also criticized Fortuna police for not searching the truck to verify if there were guns there.

A deputy DA claims that Goldberg had been terrorizing his wife with his revolver before the fatal shooting.

Jurors have the choice of acquitting Goldberg or convicting him of homicide, or of manslaughter charges. He also faces charges related to using a firearm.
